Minister of Industry and Trade Tran Tuan Anh recently issued Circular No. 11/2017 / TT-BCT regulating temporary import and re-export activities. Temporary export, re-import and transshipment of goods.
Accordingly, the Circular applies to Vietnamese non-foreign traders conducting temporary import and re-export activities; Temporary export, re-import and transshipment of goods; Relevant agencies, organizations and individuals.
Foreign-invested traders shall comply with Vietnam’s commitments in treaties to which Vietnam is a contracting party.
Goods temporarily imported for re-export may be temporarily imported for re-export through international border gates or principal border gates.
The re-export of goods through auxiliary border gates or border crossings shall be effected only at auxiliary border gates, border crossings in border-gate economic zones or border gates outside border-gate economic zones. Specialized controllers in accordance with regulations and technical facilities to ensure state management.
The auxiliary border gate and border crossing shall be announced by the People’s Committee of the border provinces after consulting and reaching agreement with the Ministry of Defense, the Ministry of Finance, the Ministry of Industry and the Ministry of Agriculture and Rural Development.
The People’s Committee of the border province exchanges with the Ministry of Industry and Trade on the principle of selecting enterprises which are allowed to re-export goods through auxiliary border gates, border crossings and announce the list of selected enterprises.
Where foreign goods are deposited in bonded warehouses for export or re-export through border provinces, the border gates of temporary import for deposit into bonded warehouses and border gates of export or re-export of goods through border provinces shall comply with regulations
In cases where goods are stuck in the area, the provincial People’s Committees shall direct functional agencies to apply measures of clearance and regulation in their localities in order to avoid congestion at ports and border gates and coordinate with customs offices. The temporary import border gate has measures to regulate the amount of goods temporarily imported from the border gate of temporary import to the border gate for re-export.
The Import-Export Department – Ministry of Industry and Trade shall grant permits for temporary import for re-export; Temporary export, re-import and transfer.
